1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Zero Point Studio d.o.o. ("we," "our," or "us"), governing your access to and use of the OnePersonHealth application, website, and all related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, our Refund & Cancellation Policy, our Health Disclaimer, and our Cookie Policy. If you do not agree to these Terms, do not use the Service.

3. Service Description

OnePersonHealth is a personal health tracking and wellness platform that provides:

  • Daily health metric logging (weight, sleep, mood, stress, energy levels)
  • Nutrition tracking with AI-powered food recognition and analysis
  • Activity and workout logging with integration to device health apps
  • Supplement tracking and management
  • Heart rate, HRV, and other vital sign monitoring
  • AI-powered health coaching and conversational assistant
  • Personalized health insights and recommendations
  • Push notifications for health reminders
  • Integration with Apple Health and Google Health Connect via mobile applications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

OnePersonHealth is not a medical device, medical service, or substitute for professional medical advice, diagnosis, or treatment. The AI-powered features, insights, recommendations, and coaching provided through the Service are for informational and general wellness purposes only. 5. Account Registration

To use the Service, you must:

  • Be at least 18 years of age
  • Provide accurate, complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activity that occurs under your account.

6. Subscription and Billing

6.1 Free Trial

New users receive a 7-day free trial with full access to all features. No payment is charged during the trial period. You must provide a valid payment method to start the trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan.

6.2 Subscription Plans

We offer monthly and annual subscription plans. Current pricing is displayed in the application and on our payment page. Subscriptions renew automatically at the end of each billing period unless cancelled.

6.3 Payment Processing

All payments are processed through Stripe, Inc. By subscribing, you authorize recurring charges to your payment method. You are responsible for all applicable taxes. We do not store your full credit card details — Stripe handles all sensitive payment information directly.

6.4 Coupons and Promotions

We may offer promotional coupon codes that provide discounts or extended trial periods. Coupons are subject to their specific terms, are non-transferable, and cannot be combined unless explicitly stated.

6.5 Price Changes

We may change pricing at any time. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

7. Your Data and Content

7.1 Your Health Data

You retain full ownership of all health data you enter, log, or sync through the Service. By using the Service, you grant us a limited license to store, process, and analyze your health data solely for the purpose of providing the Service to you.

7.2 AI Processing of Your Data

Certain features (nutrition analysis, food image recognition, health coaching chat, audio transcription) transmit your data to third-party AI providers (including OpenAI, Google Gemini, and Groq) for processing. By using these features, you consent to this data transmission. We log AI interactions locally for cost tracking and service improvement, but we do not sell your data to AI providers.

7.3 Our Intellectual Property

The Service, including its software, design, features, documentation, and branding, is owned by Zero Point Studio d.o.o. and protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription.

8. Third-Party Coach API Access

8.1 Overview

OnePersonHealth may offer the ability for you to generate an API access code that allows third-party health coaches, trainers, or other individuals to access your health data programmatically.

8.2 Your Responsibility

Enabling the API and sharing your access code is entirely voluntary. You are solely responsible for:

  • Deciding who to share your API access code with
  • Understanding what health data becomes accessible through the API
  • Revoking access codes when you no longer wish to share data
  • Any consequences arising from sharing your data with third parties

8.3 No Liability for Third-Party Actions

We provide the API infrastructure but have no control over, and accept no responsibility for, how third parties use your data once accessed via your API code. We do not vet, endorse, or certify any third-party coach or service that may access your data. You share your access code at your own risk.

8.4 Revoking Access

You may disable your API access or regenerate your access code at any time through your account settings, which will immediately revoke all existing third-party access.

9. Mobile Applications and Health App Integration

9.1 Device Health Data

Our mobile applications may connect to Apple Health (iOS) and Google Health Connect (Android) to import health data such as steps, heart rate, sleep, and workout information. This integration requires your explicit permission through your device's operating system.

9.2 Data Sync

Health data imported from device health apps is stored on our servers and treated identically to manually entered data under this agreement and our Privacy Policy.

9.3 Platform Terms

Use of our mobile applications is also subject to the terms of the platform you download from (Apple App Store, Google Play Store). In the event of conflict, these Terms govern your relationship with us.

10. Acceptable Use Policy

You agree not to use the Service to:

  • Provide false or misleading health information in your profile that could affect AI recommendations
  • Attempt to extract medical diagnoses or treatment plans from the AI assistant
  • Share your account credentials with others (use the Coach API feature instead)
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Circumvent usage limits, rate limiting, or security measures
  • Use automated tools or bots to access the Service without authorization
  • Interfere with the Service infrastructure or other users' experience
  • Use the Service for any illegal purpose
  • Resell or redistribute access to the Service without authorization
  • Abuse the AI features by submitting excessive, automated, or irrelevant requests

Violation of this policy may result in immediate suspension or termination of your account without refund.

11. Service Availability

The Service is provided "as is" without guaranteed uptime. Scheduled and unscheduled maintenance may temporarily interrupt access. We make reasonable efforts to maintain availability but do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.

12. Service Cessation Guarantee

In the event that we are unable to continue operations or choose to permanently discontinue the Service, we will provide a pro-rata refund for any unused portion of your current billing period and make reasonable efforts to allow you to export your health data before shutdown.

13. Cancellation and Termination

13.1 Cancellation by You

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • No further charges will be applied after cancellation
  • Cancellation does not trigger a refund for the current billing period

13.2 Termination by Us

We may terminate or suspend your account if you:

  • Violate these Terms or the Acceptable Use Policy
  • Fail to pay for your subscription after multiple attempts
  • Engage in suspected fraud or abuse
  • Are required to be removed by legal or regulatory order

13.3 Effect of Termination

Upon termination, your access to the Service ceases immediately. Your health data and account data may be deleted in accordance with our data retention policy. Sections of these Terms that should reasonably survive termination (such as intellectual property, limitation of liability, and indemnification) will remain in effect.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZERO POINT STUDIO D.O.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

This includes, but is not limited to:

  • Health decisions made based on information, recommendations, or AI outputs from the Service
  • Loss of health data due to technical failures or account termination
  • Inaccurate AI-generated nutrition analysis, health insights, or coaching responses
  • Failures or outages of third-party AI model providers or health app integrations
  • Unauthorized access to your data resulting from sharing your Coach API access code
  • Unauthorized access to your account due to your credential management

Our total liability for any claim arising under these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, COMPLETENESS, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, OR CORRECTION OF DEFECTS. WE MAKE NO WARRANTY THAT THE AI FEATURES WILL PRODUCE ACCURATE, COMPLETE, OR MEDICALLY SOUND RESULTS.

16. Indemnification

You agree to indemnify, defend, and hold harmless Zero Point Studio d.o.o., its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, sharing of your Coach API access code, or infringement of any third-party rights.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Zagreb, Croatia.

If you are a consumer in the European Union, you retain the right to bring proceedings in your country of residence in accordance with applicable EU consumer protection regulations.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be replaced with a valid, enforceable provision that most closely reflects the original intent. The remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Refund & Cancellation Policy, Health Disclaimer, and Cookie Policy constitute the entire agreement between you and Zero Point Studio d.o.o. regarding the Service, and supersede all prior understandings or agreements.
